Terms of Service (Including Coupon Voucher, Link-Out and Product Sales)

All Sales (Coupons Vouchers and Products) are final and refunds are provided if requested within 24 hours from date of order.

These are the universal restrictions that apply to GreenDeals Coupons (unless specifically contradicted in GreenDeals details/restrictions)

Not valid for cash back (unless required by law)
Multiple Coupons can't be combined together
Doesn't cover tax and/or shipping and handling charges
Can't be combined with other offers or coupons
Can't use until 48 hours after GreenDeal offer expires

In return for using GreenDeals, you (also referred to as "Visitor") agree to the following Terms of Service:

About GreenDeals.
GreenDeals, the website owned and operated by Q4 Marketing and Green America. All offers and promotions are offered by the merchant, not GreenDeals, although some information has been compiled by Q4 Marketing and Green America from merchant sites and materials and are not provided directly by the merchants. Q4 Marketing and Green America acts only as a venue. The material that appears on GreenDeals is for informational and advertising purposes only. Q4 Marketing and Green America is not responsible for and does not guarantee the performance of any such goods or services. Q4 Marketing and Green America is not involved in the transaction between you and merchants and does not control whether merchants honor the promotions, special offers, discounts, prices or other information listed on GreenDeals. Q4 Marketing and Green America respects the privacy of its users. See our Privacy Policy.

Coupon Voucher Sales and Redemption. Q4 Marketing and Green America offers Visitors the opportunity to purchase vouchers that will enable them to buy goods or services from an offering merchant. Visitors pay a non-refundable fixed amount (the "Cash Value") for a Voucher that generally has a higher redemption value (the "Face Value"). Q4 Marketing and Green America merely acts as the venue and conduit for this purchase: it is the Visitor who buys, and the Merchant who sells, the Voucher. The following rules apply, except where prohibited by law.

The Voucher or Voucher offer will describe the Cash Value and Face Value of the Voucher; the types of goods and/or services that may be purchased and any restrictions (for example, that a restaurant Voucher cannot be applied to alcohol, sales tax or tip, or may be used only for in-restaurant dining); the number of times it may be used; and the deadline for use ("Expiration Date"). It is at the Merchant's discretion whether Vouchers can be combined with other promotions, offers or coupons. Merchants may impose additional rules and restrictions: read the terms of the Merchant's offer and any associated information to understand the redemption rules.

Any deliberate attempt to redeem a Voucher that is inconsistent with these Voucher Sales and Redemption rules may, at the discretion of the Merchant, render the Voucher void.

Neither Q4 Marketing and Green America nor any Merchant is responsible for, or must reimburse the value of, lost, stolen or damaged Vouchers. Vouchers may not be sold or transferred (unless permitted by the Merchant); nor may they be copied or modified. If a Voucher is not redeemed by the Expiration Date, the Merchant will honor the unused Cash Value paid (but generally not the Face Value) to the extent required by law. Q4 MARKETING AND GREEN AMERICA HAS NO LIABILITY FOR REDEMPTION OF VOUCHERS OR REPAYMENT OF THEIR VALUE, but will make reasonable efforts to assist Visitors whose Merchants will not honor the Face Value (in accordance with the rules of redemption) or, after the Expiration Date, the unused Cash Value. No Visitor is entitled to a refund of the Cash Value or Face Value, but at most the opportunity to redeem the Voucher for the types of goods and services (subject to any restrictions) contained in the Voucher. State laws may provide that Merchants are obligated to honor the Cash Value for a period beyond the Expiration Date; if this applies, it is a duty of the Merchant and not Q4 Marketing and Green America. Again, Q4 Marketing and Green America is not the Merchant or sales agent and has none of the Merchant's redemption or other obligations. Click here for states law details.

Product Sales. Q4 Marketing and Green America offers Visitors the opportunity to purchase products from an offering merchant. Visitors pay a non-refundable fixed amount for the product that generally has a higher retail value. Q4 Marketing and Green America merely acts as the venue and conduit for this purchase: it is the Visitor who buys, and the Merchant who sells and ships the product. The following rules apply, except where prohibited by law.

Affiliate Link-Out. Q4 Marketing and Green America offers Visitors the opportunity to purchase products from an offering merchant’s website or e-commerce site. Visitors are offered a discount code or coupon to be redeemed on the merchants site. Q4 Marketing and Green America merely acts as the venue and conduit for this purchase: it is the Visitor who buys, and the Merchant who sells and ships the product/s.

Product and Coupon Voucher Refunds. Q4 Marketing and Green America offers Visitors the opportunity to purchase product and coupon vouchers and these orders are non-refundable. Coupon Voucher: If an e-commerce or retail location does close down or cease operations prior to the expiration deadline of coupon voucher, Greendeals will refund your purchase in full. For Product sales: GreenDeals will work with merchant to confirm products are shipped and delivered in a timely manner. If product is damaged, please contact shipper for replacement. If product is undelivered, please contact shipper for delivery issues. In most cases, Q4 Marketing and Green America merely acts as the venue and conduit for this purchase: it is the Visitor who buys, and the Merchant who sells and ships the product. The following rules apply, except where prohibited by law.

Visitor. You can become a member of Q4 Marketing and Green America by filling out the necessary information. You agree that the information you supply during that registration process will be accurate and complete and that you will not (i) register under the name of, nor attempt to enter the service under the name of, another person; nor will you (ii) adopt a user name that Q4 Marketing and Green America, in its sole discretion, deems offensive. Q4 Marketing and Green America's use of your personal information is subject to its Privacy Policy; use of your information by merchants or sites linked to or referenced by Q4 Marketing and Green America are subject to that site/merchant's policies and should be reviewed by you. Q4 Marketing and Green America does not review or take responsibility for the terms, conditions or policies of the sites and merchants to which it references or to which it links.

Visitor Responsibilities. It is your responsibility to evaluate the accuracy, completeness or usefulness of any offer, promotion or other information available through Q4 Marketing and Green America. You are responsible for confirming with the merchant any information you received through Q4 Marketing and Green America before you purchase any goods or services. If you use the services or information made available through Q4 Marketing and Green America, you must use your own judgment in completing the sale or other transaction. You are also responsible for complying with all applicable laws. You release Q4 Marketing and Green America from all claims, losses or liabilities related to your use of the services, offers, or information on GreenDeals, any related transactions or any alleged misrepresentation or breach of a merchant and agree to indemnify and defend Q4 Marketing and Green America against all claims, losses or liabilities related to the your use of the services, offers, information on GreenDeals, and any related transactions. You represent and warrant that all information supplied to Q4 Marketing and Green America, including name and email address, is accurate and personal to you. You agree that you shall not use Q4 Marketing and Green America on behalf of yourself or any other person or entity nor allow any other person or entity to use or gain access to Q4 Marketing and Green America's services through you for any purpose other than your personal use. You further agree not to use Q4 Marketing and Green America's services to conduct any non-personal or commercial competitive analysis of services or products offered by merchants.

Linked Websites. GreenDeals contains links to other websites that are not operated by Q4 Marketing and Green America. Q4 MARKETING AND GREEN AMERICA DOES NOT CONTROL THESE WEBSITES AND DOES NOT ENDORSE OR TAKE RESPONSIBILITY FOR THE CONTENT OR SERVICES AVAILABLE ON THE LINKED WEBSITES. The existence of such links shall not be construed as an endorsement of the material appearing on such sites. You should check the terms of use and privacy policies of all sites you link to from our site.

Code of Conduct/Right to Terminate: You will not post or distribute any materials that are abusive, libelous, defamatory or obscene; or that are fraudulent or deceptive; or that violate anyone's copyrights or other intellectual property; or that violate anyone's confidentiality or privacy; or that harass, threaten, or are otherwise inappropriate. You will not falsely identify the source of any communications or materials, deliberately mislead anyone as to your identity (including impersonating a representative of Q4 Marketing and Green America), use the site to transmit unsolicited email, or act contrary to the law. You will indemnify us if we get sued because of your misconduct. We can terminate your access to the Q4 Marketing and Green America (i) for any actual, apparent, threatened or accused misconduct, or (ii) in our discretion for any reason.

Uploaded Materials: You represent that you will have the right to post or upload to Q4 Marketing and Green America any information or materials that you do post or upload, and you hereby license us and other members to make unrestricted and perpetual use of any such materials you make available in a public area of this website. You will indemnify us and any members who get sued because you violate this promise.

Objectionable Content/Copyright Policy: If you believe your rights have been violated by, or you otherwise object to, any posting, content or information on the Q4 Marketing and Green America site, please contact Jonah Mytro at greendeals @ q4marketing.com promptly so we can evaluate the claim and take appropriate action. It is Q4 Marketing and Green America's policy to respond promptly to claims of copyright infringement, and to remove, or disable access to, infringing material. If you believe that any of the content or materials appearing on Q4 Marketing and Green America contain infringements, please send a notice to us at the address below. Your notice should contain the following: a physical or electronic signature of a person (i.e., claimant) authorized to act on behalf of the copyright owner; identification of the copyrighted work claimed to be infringed; identification of the content or material claimed to be infringing; a reference or link to the infringing material or activity, or the subject of the infringing activity, including information to enable us to locate that material or reference; the address, telephone number or email address of the claimant; a statement that the claimant has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and a statement that the information in the notice is accurate and, under penalty of perjury, that the claimant is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Ownership. Q4 Marketing and Green America and/or its agents, licensors, site sponsors, participating merchants, advertisers, strategic partners and other content providers retain all rights to their applicable services, special offers, advertisements, promotions and the related text and graphics displayed on or accessed via GreenDeals. All trademarks, logos, service marks and corporate identifiers ("Marks") displayed on GreenDeals are the property of Q4 Marketing and Green America and/or its agents, licensors, site sponsors, participating merchants, advertisers, strategic partners and other content providers. Visitors are prohibited from using any Marks without the written permission of Q4 Marketing and Green America as well as such third party which may own the Marks. All content on GreenDeals is protected by copyright and, other than for personal and non-commercial purposes, Visitors are prohibited from modifying, using, publishing, distributing, transmitting, displaying, reproducing, selling, licensing, creating derivative works from, or otherwise exploiting any of the content of GreenDeals. All materials submitted to GreenDeals via form or email become property of GreenDeals, including but not limited to user questions, recipes, savings tips, and articles.

Disclaimer of Warranties and Limitation of Liability. THE GOODS, SERVICES, OFFERS, PROMOTIONS AND INFORMATION ON GREENDEALS (OR ANY INFORMATION, GOODS OR SERVICES THAT ARE REFERRED TO, PROVIDED BY OR ADVERTISED ON GREENDEALS) ARE PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS. THE ONLY WARRANTIES MADE RESPECTING THESE ITEMS, IF ANY, ARE THOSE OFFERED BY THE MERCHANT PROVIDERS. (For more information, check the offer, Merchant site or Merchant.)

Q4 MARKETING AND GREEN AMERICA DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, FREEDOM FROM ERROR, DEFECTS OR VIRUSES, AVAILABILITY AND NON-INFRINGEMENT WITH RESPECT TO ITS SITE AND SERVICES, ANY THIRD PARTY GOODS OR SERVICES OFFERED OR SOLD THROUGH Q4 MARKETING AND GREEN AMERICA, OR THE QUALITY, FEATURES OR CHARACTERISTICS OF SUCH GOODS AND SERVICES. Q4 MARKETING AND GREEN AMERICA DOES NOT GUARANTEE CONTINUOUS, UNINTERRUPTED OR SECURE ACCESS TO ITS SERVICES, AND OPERATION OF THE SITE MAY BE INTERFERED WITH BY NUMEROUS FACTORS OUTSIDE Q4 MARKETING AND GREEN AMERICA'S CONTROL.

Q4 MARKETING AND GREEN AMERICA SHALL NOT BE LIABLE HEREUNDER (I) IN EXCESS OF THE FEES PAID BY YOU IN THE SIX MONTHS PRIOR TO THE EVENT GIVING RISE TO YOUR CLAIM; OR (II) FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER, INCLUDING BUT NOT LIMITED TO DAMAGES RELATED TO SERVICES, OFFERS, INFORMATION ON GREENDEALS, ANY TRANSACTIONS MADE AFTER USE OF GREENDEALS, ANY LOSS OR DAMAGE CAUSED BY YOUR RELIANCE ON INFORMATION OBTAINED THROUGH GREENDEALS, OR ANY OFFER MISREPRESENTED OR NOT FULFILLED BY A MERCHANT. Some states do not allow limitations on how long an implied warranty lasts or the exclusion of incidental or consequential damages so the above limitations and exclusions may not apply to you. You may also have other legal rights, which vary from state to state.

Changes. Q4 Marketing and Green America may modify its site, services or these terms at any time by changing these Terms of Service or other information on GreenDeals. Such modification includes, without limitation, restricting access, suspending, or discontinuing service, changing the rules of use, and terminating your use. By using GreenDeals after such changes, you agree to be bound by these Terms of Service, as modified.

Miscellaneous. These Terms of Service shall be construed in accordance with the laws of the Commonwealth of Massachusetts, excluding conflict of laws provisions. The parties shall bring any cause of action arising under these terms in a Federal or state court located in Boston, Massachusetts. Access to and use of GreenDeals are subject to all applicable United States and foreign laws and regulations, including export laws. If any provision herein is held to be illegal or unenforceable, that provision shall be limited to the minimum extent necessary so that it is enforceable. These Terms of Service constitute the entire agreement of the parties with respect to its subject matter and supersede all prior agreements. A waiver of a provision of these Terms of Service shall not constitute a waiver of any other provisions. The headings are for convenience only and do not modify any provisions.
